1. Acceptance of Terms
By accessing or using BotDesk's platform, website, and services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
BotDesk provides cloud-based virtual desktop infrastructure designed for AI agents. The Service includes cloud computers, agent management tools, monitoring dashboards, session recording, and related features as described on our website.
3. Account Registration
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Distribute malware, spam, or harmful content
- Attempt to gain unauthorized access to other systems
- Engage in cryptocurrency mining without authorization
- Overload or interfere with the Service infrastructure
5. API Keys and BYOK
When you provide your own API keys through our BYOK system, you are responsible for any costs incurred with those third-party providers. BotDesk is not liable for charges from third-party AI providers resulting from your agents' usage.
6. Billing and Payment
Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to modify pricing with 30 days' notice. Usage beyond your plan's included limits may incur additional charges.
7. Intellectual Property
You retain all rights to your data and the output produced by your agents. BotDesk retains all rights to the Service, including its software, design, and documentation. You may not copy, modify, or reverse engineer any part of the Service.
8. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance with reasonable notice. We are not liable for any downtime or service interruptions.
9. Limitation of Liability
To the maximum extent permitted by law, BotDesk shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service.
10. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms. You may cancel your account at any time. Upon termination, your right to use the Service ceases immediately, and your data will be deleted according to our data retention policy.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
